It is legal as long as it is not a game fish.  ie Bass, Trout.  I will double check but it may take a day of research Fish and Wildlife are difficult to get ONE straight answer from in Raleigh.

Is it legal to catch and keep them as long as they are not sold, or do you need a permit?

It would be legal as long as they are farm raised and not taken from local waters and then sold IIRC.

I'll need some soon, I'm planning a big native tank, but I'm about a year out. Does the fish wagon come around occaisionally, like a weird ice cream truck.
Not that I care, but is it legal.

ANNOUNCEMENT: Do you have a pond (or a very large aquarium) that you want to stock with some local native fish like bluegill, channel cats, mosquito fish, etc.?

A company called FishWagon will be in the parking lot of Southern States on Riverside Dr in Asheville next Thursday, March 12th from 9AM to 10AM selling live fish. Here is their website:

I don't know too much about this, but I did call and talk to the owner about getting some bluegill for my pond (which was devastated by the drought last year). They sell them 25 to a bag. He said If anyone wants large quantities of any species then call ahead. Otherwise, just show up he'll have smaller quantities of everything there.

Anyway, just a heads up for anyone looking for fish to stock their pond this year.
